Introduction
Student Conductor, Inc. ("Student Conductor", “us” or "we") respects your privacy and is committed to protecting your privacy through compliance with this Privacy Notice. We value the trust you place in us and we want to ensure that you understand what information we collect through the website located at www.StudentConductor.com (the “Website”), what information we collect in connection with the internet-based, subscription services available through the Website (the “Services”), how we use and disclose that information, and the safeguards we have in place to protect that information. For purposes of this Privacy Notice, accessing or using the Services constitutes use of the Website.

Please read this policy carefully to understand Student Conductor’s practices regarding personal information. If you do not agree with Student Conductor’s practices, do not access or use the Website. By accessing or using the Website, you agree to this Privacy Notice. The terms of this Privacy Notice may change from time to time (see “Changes To Our Privacy Policy” section below). Your continued use of the Website after we notify you of changes constitutes your acceptance of those changes.

Information We Collect From You
We may collect information from you as a Website user if you fill out any of the forms on the Website. The personal information we may collect from you through the Website includes: your first and last name, email address, and telephone number. We may also collect the following types of information that may concern you but do not necessarily identify you individually: the name of the school you represent, average number of students, preferred dates and times for a Services demonstration, copies of your correspondence, and/or the reason for your inquiry or request.

We also collect the following information from school districts and educational institutions (“Schools”) that subscribe to our Services: student data (i.e., students’ first names, last names, grade levels, student ID numbers, parent email addresses, and parent phone numbers), the School’s account username and password, the School-designated administrator’s first and last name, work telephone number, student population, type of school or school district, title, work email address, and the name and address of the School. Student Conductor requires Schools to obtain parental consent before disclosing student data to Student Conductor. Student Conductor treats student data as personal information under this Privacy Notice.

How We Collect Information
We collect information from and about you through the Website when you provide it to us. For instance, if you submit an inquiry to Student Conductor through the “Contact Us” page of the Website or you request a demonstration of the Services through the “Schedule Demo” page of the Website, we collect the information you provide. We collect information from and about Schools when a Services account is created by the School, and when a School subscribes to the Services. We collect student ID numbers through kiosk located in Schools. We also collect information directly from School representatives.

Automatic Information Collection and Tracking
The Website and Services use cookie technology as described in this section. A cookie is a small piece of information sent by a website that is saved on your computer by your computer's browser. A cookie holds information a website may need to personalize your experience or to allow you to easily login.

You may elect to activate cookies by affirmatively selecting the “Remember Me” feature on the Services’ login page. These cookies enable the Services to remember your login credentials (i.e., first and last name, email address/username, and encrypted password) to facilitate a faster login process the next time you login to the Services. Please note that if you log off, the “Remember Me” cookies will be deleted from your computer and you will be asked for your login credentials the next time you attempt to gain access to the Services. If you do not want the Services to remember your login credentials, please do not select the “Remember Me” feature on the Services’ login page or please click the “Log Off” button if you previously selected the “Remember Me” feature but would no longer like the Services to remember your login credentials.

Student Conductor also uses standard web server log files to help us count Website visitors and evaluate the Website’s technical capacity. We use this information to find out how many people visit the Website, to help us arrange the pages in the most user-friendly way, to keep the Website browser-friendly, and to make our pages more useful to you. We record this information on Website traffic but not on individual users. To use the Website without cookies, you can configure your browser to reject all cookies, or to notify you when a cookie is set. Each browser is different, so check the "Help" menu of your browser to learn how to change your cookie preferences. Please note that you will not be able to login and access the Services if you elect to reject cookies.

The Services also track school administrators’ activities while using the Services.

Except as set forth in this section, Student Conductor does not engage in automatic information collection or tracking when you access or use the Website or Services.

How We Use Information
We may disclose non-personally identifiable aggregated information that does not identify any individual or device without restriction.

We use personal information that you submit to Student Conductor:

  • To provide Schools with the Services if you are subscribed to the Services;
  • Respond to your requests or inquiries;
  • Give Schools notices about your account/subscription;
  • Store School login credentials to speed up the login process;
  • Provide you with electronic marketing materials pertaining to Student Conductor and its products and/or Services, which you may opt out of by using the opt-out link at the bottom of such marketing materials;
  • Arrange the Website in a user-friendly manner;
  • Customize your browsing experience;
  • Improve the Services;
  • Notify Schools of changes to, or special features of, the Services; and
  • Fulfill any other purpose for which you provide it.

Disclosure of Information
Student Conductor does not sell personal information, and Student Conductor only discloses personal information under the following circumstances: ·
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Student Conductor’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Student Conductor is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce our rights or investigate violations arising from any contracts entered into between you and us, including the Terms and Conditions of Use applicable to the Website and the Services.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Student Conductor or any third party.

Accessing and Correcting Your Personal Information
You must contact Student Conductor via email at privacy@studentconductor.com in order to access, change, or delete any personal information that you have provided to us. If you are a subscribed School, information regarding your account, including any information provided by the School’s contact person, can be reviewed and changed by logging into the School’s account using the school’s login information. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Data Security
The security of your personal information is very important to us and we are committed to protecting the information we collect. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a username and/or password for access to certain parts of the Services, you are responsible for keeping your username and password confidential. We ask you not to share your username or password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although Student Conductor does its best to protect personal information, we cannot guarantee the security of personal information transmitted through the Website or Services. Any transmission of personal information, including student data, is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Third-Party Sites and Links
Our Website and Services may provide links to, or features from, other third-party sites. If you link to or use such third-party sites or features, you do so at your own risk. We do not control and are not responsible for the content or practices of any third-party site, application, or feature. The applicable third party’s processing and use of any personal information you provide to the third party is governed by the third party’s privacy notice. We encourage you to carefully review the applicable third party’s privacy notice before providing any personal information to that third party.

Student Data
Student Conductor’s Website is not intended for use by minors; however, because Student Conductor’s Services are intended to assist Schools with tracking certain school-related activities for middle school and high school students, Student Conductor collects information, including personal information, from Schools regarding the schools’ students. Specifically, Schools that have subscribed to the Services provide Student Conductor with the following information pertaining to their middle school and/or high school students: the student’s first name, last name, grade level, student ID number, and parent email addresses and phone numbers. In some instances, students may scan their student ID cards into the Services at a kiosk located in their School in order to obtain a tardy slip. Through the Services, the student’s ID number is matched with the student’s first and last name so that the Services may track the student’s tardy on behalf of the School and provide notices and communications to the student’s parents on behalf of the School. When the School provides Student Conductor with a student’s data, the School consents to Student Conductor’s use of that data in accordance with this Privacy Notice. Under federal law, the School’s consent to Student Conductor’s use of the student’s data is the equivalent of parental/guardian consent to such use.

Except as set forth in this paragraph, any personal information submitted by a School to Student Conductor is used by Student Conductor solely to provide the Services to the School. Student Conductor does not serve ads through the Services, market to students or their parents, or use student data for any commercial purposes. Student Conductor does not sell student data to third parties.

Parents can access their student’s personal information or request that this information be deleted or modified by Student Conductor through the designated School administrator. If we learn we have collected or received personal information from a student without verification of parental consent, we will delete that information. If a parent wishes to stop any further collection or use of his/her student’s personal information, the parent can make his/her request to the School administrator and the School administrator is then obligated to make that request known to Student Conductor. Student Conductor will delete or modify a student’s personal information upon request of the School administrator.

Student Conductor will ensure that all student data in its possession are destroyed or transferred to the School under the direction of the School when the student data is no longer needed for the Services at the request of the School.

Student Conductor complies with the Family Educational Rights and Privacy Act (“FERPA”) and other applicable laws pertaining to students’ privacy rights.

Changes to Our Privacy Notice
We may update our Privacy Notice from time to time. If we make material changes to how we treat Website users’ personal information, we will post the updated Privacy Notice on this page with a note on our homepage that the Privacy Notice has been updated. A Website user’s use of the Website, the updated Privacy Notice, and a note on our homepage regarding such update has been posted constitutes the user’s consent to Student Conductor’s treatment of personal information as set forth in the updated policy. In the case of Schools subscribed to the Services, we will notify you of material changes to how we treat student data via email to the email address specified in the Schools’ account. A School’s use of the Services after we notify it of changes constitutes its consent to Student Conductor’s treatment of personal information as set forth in the updated Privacy Notice.

The date the Privacy Notice was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this page to check for any changes.
